My Whistler Concierge warrants to you that My Whistler Concierge shall use its reasonable endeavors to provide its services with reasonable care and skill and, as much as reasonably possible, in accordance with your request and instruction from time to time. Where My Whistler Concierge supplies you with any goods or services supplied by a Provider(s), then My Whistler Concierge is acting exclusively as your agent in sourcing such goods or services. My Whistler Concierge endeavors to use reasonable care in selecting any Provider(s) and ensuring any order you place with us is in accordance with your wishes. For the avoidance of doubt, My Whistler Concierge does not and will not provide any representations or recommendations in relation to any of the information and suggestions comprised within its services. You are deemed to be responsible for, and shall use your own skill and judgment as to the quality, value, safety, appropriateness and suitability of such information and suggestions in relation to deciding whether to enter into any contract with any Provider(s) for the supply of services or sale of goods. 

 

DISCLAIMER

 

Your contract for the purchase of products or services is made with the relevant Provider(s). My Whistler Concierge acts exclusively as an agent for the Provider(s) and, unless expressly provided otherwise, all your rights and remedies are against the Provider(s). My Whistler Concierge will not be responsible for products and services offered by My Whistler Concierge as agents for the Provider(s) or for any aspect of the relationship between you and the Provider(s). My Whistler Concierge will, however, do everything it reasonably can to assist you in any dealings you have with the Provider(s). 

 

You agree that any contract entered into by you with any of the Provider(s) is an independent contract. My Whistler Concierge hereby disclaims any and all liability for any act or omission of any Provider(s) or any loss incurred by you or by participants booked under your name and as a result of any act or omission of a Provider(s) whether or not arranged through My Whistler Concierge. My Whistler Concierge accepts no liability for any losses or claims arising from any inability to access the website or any failure to complete a transaction. All bookings requested are contingent on a Provider(s) posted availability at the time of booking. My Whistler Concierge is not responsible for the failures or malfunctions of its third-party booking software but will make every reasonable effort to book the activity(ies) you request, at the time you request.  

 

 

LIABILITY

My Whistler Concierge shall not be liable for any loss, cost, expense, personal injury (incl. death) or property damage of any nature whatsoever (whether direct or indirect) resulting from the provision of its services or your reliance upon the information and suggestions provided by My Whistler Concierge and the resulting supply of goods and services to you by any Provider(s). My Whistler Concierge shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests or instructions supplied by you which are incomplete, incorrect or inaccurate or arising from their late arrival or non-arrival, or any other fault of you. If the delay or failure was due to any cause beyond My Whistler Concierge’s reasonable control, My Whistler Concierge shall not be liable to you or be deemed to be in breach of these Terms and Conditions by reason of any delay in performing or any failure to perform its obligations in relation to its services.

TICKETS/EVENTS

My Whistler Concierge actively provides access to a number of events in and around Whistler through numerous ticket agent partners. My Whistler Concierge is not the issuer, original seller or a reseller of tickets. Please note that often when purchasing tickets, you are purchasing tickets above face value, which may include service charge(s) reflecting costs and efforts in obtaining premium seats or event-time slots. Ticket prices are not set by My Whistler Concierge and are subject to market conditions and demand.

In the event of show cancellations directly by the artist, promoter or Provider(s), My Whistler Concierge will make all reasonable efforts to issue a refund to you. My Whistler Concierge or its ticket agent partner will dispatch your tickets by the best available delivery service that suits your needs. Please note that neither My Whistler Concierge nor its ticket agent partners can be held liable for any failure by a courier or other electronic communication delivery service to deliver your tickets.
